1. Platform Description

TheranosTest is a neutral information platform where users can research companies and share evidence of potential fraud or misconduct. All company scores, reviews, and evidence are either user-submitted or generated through automated AI analysis of publicly available information. TheranosTest does not create, endorse, or verify the accuracy of user-submitted content. We are a technology platform, not an investigative agency, legal advisor, or financial consultant.

2. User Eligibility

You must be at least 18 years old to submit content to TheranosTest. By using this platform, you represent that you meet this age requirement. No account is required to view content. If you choose to provide an email address for submission notifications, you must provide accurate contact information.

3. User-Submitted Content & Legal Responsibility

3.1 Your Responsibility

When you submit evidence, reviews, or any content to TheranosTest:

• You represent and warrant that all information is true and accurate to the best of your knowledge
• You confirm you have the legal right to share all uploaded files and information
• You accept FULL LEGAL RESPONSIBILITY for the accuracy and legality of your submission
• You acknowledge that false, defamatory, or misleading statements may subject YOU to legal liability, including lawsuits, criminal charges, and damages
• You understand that anonymous submissions do not shield you from legal consequences if your content is illegal or defamatory

3.2 Indemnification

You agree to indemnify, defend, and hold harmless TheranosTest, its owners, operators, employees, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your submitted content
• Your violation of these terms
• Your violation of any third-party rights, including defamation, privacy violations, or intellectual property infringement
• Any legal action taken against you for false or misleading statements

3.3 Content License

By submitting content, you grant TheranosTest a worldwide, non-exclusive, royalty-free license to display, distribute, and use your submission on the platform. You retain ownership of your content but cannot revoke this license once submitted.

4. Evidence Verification & Disclaimers

4.1 Automated Screening

We use automated tools to screen submissions for obviously fake, spam, or AI-generated content. Some submissions may be reviewed by volunteer moderators. However, we make NO guarantee regarding verification accuracy. Verification badges (AI-Verified, Expert-Verified, etc.) indicate our assessment of submission quality, NOT factual truth or legal validity.

4.2 No Guarantee of Accuracy

TheranosTest does not independently investigate, fact-check, or verify user-submitted claims. We are not liable for inaccurate, false, or misleading content posted by users. All content should be considered alleged information, not verified fact.

5. AI-Generated Scores & Analysis

Company risk scores (0-100) are generated through automated AI analysis of publicly available information and user-submitted evidence. These scores represent algorithmic opinions, not editorial judgments by TheranosTest. Scores are informational only and should not be considered:

• Investment advice
• Legal advice
• Medical advice
• Professional recommendations of any kind
• Verified facts about any company

Scores may be inaccurate, incomplete, or outdated. Always conduct your own independent research before making financial, medical, or business decisions.

6. Company Responses & Content Integrity

Companies or their authorized representatives may submit official responses that will appear on their profile pages. Companies cannot pay to alter, remove, or influence their scores. TheranosTest does not accept payment for content removal, score manipulation, or favorable treatment. Responses must comply with these terms and may be removed if they violate our policies.

7. Content Removal & Dispute Process

7.1 Our Right to Remove Content

We reserve the right (but have no obligation) to remove or modify any content that:

• Violates applicable law (including but not limited to illegal content, threats, harassment, child exploitation)
• Is clearly spam, malware, or phishing
• Is manifestly false or fabricated
• Violates these Terms of Service
• Infringes on intellectual property rights

7.2 Dispute & Takedown Requests

Companies or individuals who believe content is false, defamatory, or otherwise violates these terms may submit a dispute by emailing hello@theranostest.com with:

• Specific content in question (URL or description)
• Detailed explanation of why it should be removed
• Supporting evidence demonstrating the content is false or illegal
• Contact information for follow-up

We will investigate disputes in good faith but are not obligated to remove content simply because it is negative, critical, or disputed. Removal decisions are made at our sole discretion.

7.3 Counter-Notification

If your content is removed following a dispute, you may submit a counter-notification with evidence supporting your submission's accuracy. We will review and may restore content if the dispute appears unfounded.

8. Platform Immunity & Liability Limitations

8.1 Section 230 Protection (United States)

TheranosTest is a neutral interactive computer service provider under 47 U.S.C. § 230 (Section 230 of the Communications Decency Act). We are not the publisher or speaker of user-submitted content and are not liable for content created by users. This includes defamation, privacy violations, or other claims arising from user posts.

8.2 International Users

For users outside the United States: We operate as a hosting service provider and claim immunity under applicable laws, including but not limited to the EU Digital Services Act and e-Commerce Directive Article 14. However, we make no guarantee that such protections apply in your jurisdiction.

8.3 DISCLAIMER OF WARRANTIES

9. Prohibited Uses

You agree NOT to:

• Submit false, fabricated, or deliberately misleading information
• Impersonate others or misrepresent your identity or affiliation
• Upload malware, viruses, or harmful code
• Attempt to hack, scrape, or disrupt the platform
• Use the platform for illegal purposes
• Harass, threaten, or intimidate others
• Violate any applicable laws or regulations
• Submit content you do not have the right to share (copyrighted material, private information, etc.)

Violation of these prohibitions may result in content removal, banning from the platform, and legal action.

10. Privacy & Data Collection

We collect minimal user data. If you provide an email address, it is used only for:

• Sending notifications about your submissions (verification status, responses, etc.)
• Responding to your inquiries

Data Retention: Submitted content may remain on the platform indefinitely unless removed per our dispute process. Email addresses may be deleted upon request.

11. Arbitration & Dispute Resolution

11.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or use of TheranosTest (including disputes about the validity, scope, or enforceability of this arbitration agreement) shall be resolved through binding arbitration rather than in court, except as provided below.

Arbitration will be conducted under the rules of the American Arbitration Association (AAA) in New Jersey, USA. The arbitrator's decision is final and binding.

11.2 Class Action Waiver

YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION AGAINST THERANOSTEST. All disputes must be brought individually.

11.3 Exceptions

Either party may seek injunctive relief or other equitable remedies in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

11.4 30-Day Opt-Out

You may opt out of this arbitration agreement by sending written notice to hello@theranostest.com within 30 days of first using TheranosTest. Opt-out notices must include your name and a clear statement that you wish to opt out of arbitration.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of New Jersey, United States of America, without regard to conflict of law principles.

For any disputes not subject to arbitration (or if you opt out), you agree that exclusive jurisdiction and venue lie in the state and federal courts located in New Jersey. You waive any objection to jurisdiction or venue in these courts.

13. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of TheranosTest after changes constitutes acceptance of the modified Terms. We encourage you to review this page periodically.

14. Termination

We may suspend or terminate your access to TheranosTest at any time, for any reason, without notice. Upon termination, these Terms remain in effect regarding your prior use and submissions. Sections related to indemnification, liability limitations, arbitration, and governing law survive termination.

15. No Platform Guarantee

We make no guarantee that TheranosTest will remain operational. The platform may be discontinued, modified, or shut down at any time without notice or liability. We are not responsible for data loss or unavailability of the service.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheranosTest regarding use of the platform and supersede any prior agreements or understandings.
